Scout Haus operates a curated booking and coordination platform designed to connect distinctive properties with creators, brands, and private clients seeking spaces for productions, events, gatherings, stays, and related uses.
Please read this Agreement carefully. It governs your access to and use of the Scout Haus platform, websites, applications, services, and any related tools or communications (collectively, the “Services”).
IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION:
Except where prohibited by applicable law, this Agreement contains waivers of jury trials and class actions and requires binding arbitration for most disputes. If you do not agree, you may not use the Services.
1. DEFINITIONS AND ROLE OF SCOUT HAUS
When this Agreement refers to “Scout Haus,” “we,” “us,” or “our,” it refers to:
Scout Haus LLC, an Arizona limited liability company.
Scout Haus provides booking, marketing, and coordination services only. Scout Haus:
Is not a property owner
Does not lease or rent property
Does not take possession or control of properties
Does not operate properties
Does not provide lodging, accommodation, or real estate services
All rights of use of any property are granted directly by the property owner to the guest.
2. NATURE OF THE PLATFORM AND SERVICES
2.1 Platform Purpose
Scout Haus operates a curated platform that enables:
Property owners to make spaces available for approved uses
Guests to discover and book spaces
Coordination of bookings, access, and logistics
Marketing and media services related to listed properties
Scout Haus does not endorse or guarantee any property, owner, guest, or third party.
2.2 No Ownership or Control
Scout Haus does not own, lease, manage, or control any listed property.
Scout Haus’s role is limited to facilitating introductions, bookings, and coordination as expressly authorized by property owners.
2.3 Independent Parties
Property owners, guests, vendors, and service providers are independent third parties. Scout Haus is not responsible for their conduct, performance, or compliance with law.
3. USER ACCOUNTS AND ELIGIBILITY
3.1 Eligibility
You must be at least 18 years old and legally capable of entering binding agreements to use the Services.
3.2 Account Responsibility
You are responsible for all activity conducted through your account and for maintaining accurate information. Scout Haus may suspend or terminate accounts for violations of this Agreement.
4. BOOKINGS AND CONTRACTUAL RELATIONSHIPS
4.1 Direct Contract Between Owner and Guest
When a booking occurs:
The booking agreement is solely between the Guest and the Property Owner
Scout Haus is not a party to that agreement
Scout Haus acts only as an agent for booking and coordination
4.2 No Lease or Tenancy
Bookings grant a temporary, revocable license to use a property for the approved purpose and duration only.
No booking creates a lease, tenancy, landlord-tenant relationship, or innkeeper relationship.
4.3 Booking Authority
Property owners may authorize Scout Haus to accept bookings within pre-approved parameters. Scout Haus may decline bookings at its discretion for safety, compliance, or operational reasons.
5. PAYMENTS, FEES, AND COLLECTION
5.1 Service Fees
Scout Haus charges service fees for use of its Services. These may include booking fees, coordination fees, and marketing fees as disclosed prior to confirmation.
5.2 Limited Payment Collection Agent
Where Scout Haus facilitates payment collection, Scout Haus acts as a limited payment collection agent for the property owner.
Payment to Scout Haus satisfies the guest’s payment obligation to the owner, subject to successful receipt of funds.
Scout Haus does not act as an escrow, trustee, or fiduciary.
5.3 Deposits and Authorizations
Security deposits or damage holds may be collected via temporary authorization or other approved methods and are not service fees.
6. PROPERTY CONDITIONS AND USE
Property owners are solely responsible for:
The condition, legality, safety, and suitability of their property
Compliance with zoning, HOA rules, permits, and regulations
Disclosure of restrictions, rules, and surveillance devices
Scout Haus does not inspect or certify properties.
7. MEDIA AND CONTENT
7.1 Media Capture
Scout Haus may capture photography, video, or audio media of properties, including drone footage where lawful.
7.2 Ownership
All media created by Scout Haus or its contractors is owned by Scout Haus.
7.3 Limited License to Owners
While engaged with Scout Haus, owners receive a limited license to use media for marketing their property. Continued use after termination requires purchase of a media license.
8. INSURANCE
8.1 Owner and Guest Responsibility
Property owners and guests are solely responsible for obtaining appropriate insurance coverage for their property, events, and activities.
8.2 Scout Haus Coverage
Scout Haus maintains its own commercial general liability and professional coverage for its role as an agent. This coverage does not extend to property damage, guest injury, or event risks.
9. DISCLAIMERS
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
SCOUT HAUS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE.
USE OF ANY PROPERTY INVOLVES INHERENT RISK. USERS ASSUME ALL SUCH RISKS VOLUNTARILY.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Scout Haus shall not be liable for indirect, incidental, consequential, or punitive damages
Scout Haus’s total liability shall not exceed the service fees paid to Scout Haus for the booking giving rise to the claim
11. INDEMNIFICATION
You agree to indemnify and hold harmless Scout Haus from claims arising out of:
Your use of a property
Your breach of this Agreement
Your violation of law
Damage, injury, or loss caused by you or your guests
12. DISPUTE RESOLUTION AND ARBITRATION
All disputes arising from this Agreement shall be resolved by binding arbitration, except where prohibited by law.
No class actions or jury trials are permitted.
13. TERMINATION
Scout Haus may suspend or terminate access at any time for violations, risk, or operational reasons. Provisions that should survive termination shall do so.
14. GOVERNING LAW
This Agreement is governed by the laws of the State of Arizona.
15. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and Scout Haus regarding the Services and supersedes all prior agreements.
